The two main options available for individuals in debt under the federal Bankruptcy Code are Chapter 7 and Chapter 13 bankruptcies.

Chapter 7 liquidation leads to discharge of all of your eligible debts. However, you may need to give up some nonexempt assets, which the bankruptcy trustee will sell to partially repay your creditors.

Chapter 13 adjustment of debts involves the creation of a payment plan under which you will repay some of your creditors over a period of three to five years. It may allow you to keep certain property that you would have to give up under Chapter 7.
